Trains not only pose a risk of injury to people on the train but also people who are on or near train tracks. When people stand near trains, they can be injured by either the train itself or the debris flying off the train tracks.
A person's best strategy for avoiding a train injury is to keep a safe distance away from train tracks. However, when a person's car is parked near a train track and the car is hit by debris from the train, then this could cause serious injury to drivers and passengers.
In such a case, the train company or the driver may be liable for the injuries. If the train has not taken enough precautions to secure its cargo, then the train may be liable. On the other hand, if the person is parked at an unsafe distance from the train, the person may be liable.
